The lawsuit filed by fast food chain Jack in the Box against FTX US for allegedly infringing mascot-related copyrights and trademarks has ended after the parties reached a settlement.
The parties notified the U.S. District Court for the Southern District of California that they had resolved the dispute through a motion to dismiss on January 20, but details of the settlement were not disclosed.
Jack in the Box originally filed a lawsuit in early November, alleging that the look and behavior of FTX US’ “Moon Man” mascot plagiarized “Jack”, the Jack in the Box mascot, whose trademark rights date back to 1995 year. Jack in the Box initially sought damages for allegations of copyright infringement, trademark dilution, trademark infringement, false appellations of origin and unfair competition.
